Zoning Hearing Board Special Meeting on Wednesday, July 18 at 7:30 PM:

  • Pending application for a zoning variance to convert a single family home located at 444 McElheny Road into a rehabilitation home for brain injury patients.
    Scioto Properties owner of 444 McElheny Road, requesting a substantive validity challenge to the zoning ordinance pursuant to Section 909.1 (a)(1) Pennsylvania Municipalities Planning Code because, Applicant asserts that the failure of the Shaler Townsihp Zoning Ordinance to permit the proposed use in the R-1 and R-2 zoning districts violates the Fair Housing Act (42 U.S.C. 3601), Section 504 of the Rehabilitation Act (29 U.S.C. 701) and the Americans with Disabilities Act (42 U.S.C. 12101) as well as the Equal Protection Clause of the Constitution of the United States and the Constitution of Pennsylvania.  Lot and block 433-R-120 and 433-R-115.
